TERMS OF SALES
FROM THE FAR WEST RANCH
1/ REGISTRATION AND PAYMENT
The general conditions of sale are recognized as read and approved upon receipt of the first payment (including deposit) or following online registration via our website. Registration then becomes effective. In accordance with Article L.121-20-4 of the Consumer Code, people registered for a service do not benefit from the seven-day withdrawal period.
1.1 Methods of payment:
Online payment from our website.
The customer agrees, prior to any reservation, to complete the information requested on the site. The customer certifies the veracity and accuracy of the information provided. After the final choice of the services to be reserved, the reservation procedure includes in particular the entry of the bank card, the consultation and acceptance of the general conditions of sale and the conditions of sale of the reserved rate before the validation of the reservation and, finally , the validation of the reservation by the customer.
The reservation platform subcontracted by Ultinow acknowledges receipt of the customer's reservation by sending an email without delay. In the case of online booking, the acknowledgment of receipt of the reservation by e-mail summarizes the contract offer, the services reserved, the prices, the cancellation conditions relating to the selected rate, accepted by the customer, the date of reservation made, information relating to after-sales service, as well as the address of the seller's establishment to which the customer can submit his complaints.
On the Internet via our online booking platform processed by Ultinow, the balance of the services is requested upon registration regardless of the registration deadline before the service.
2/ CHANGES REQUESTED BY THE CUSTOMER
2.1 Cancellation:
Any modification of cancellation must be made by any means allowing to obtain an acknowledgment of receipt. In all cases, FAR WEST RANCH charges cancellation fees calculated on the total price including VAT of the service and varying according to the date of cancellation, according to the conditions below. Cancellation fees (variable depending on the number of days preceding the service):
the day before departure: 100% of the price of the service
from 2 to 7 days before the day of departure: 50% of the price of the service
More than 8 days before the day of departure: 10% of the price of the service (amount corresponding to the management and reimbursement costs)
2.2 Change or modification of the service:
Any change of service or dates must be notified no later than 7 days before the departure date by any means allowing an acknowledgment of receipt to be obtained. Any change request sent less than 7 days before the departure date is considered a cancellation and entails the application of the cancellation conditions above. The renunciation of one of the services included in a service cannot be the subject of any refund.
2.3 Modification during the service:
Any modification of the program made at the request of the participant can only be implemented after agreement of the guide and the whole group. In this case, the additional costs incurred are the responsibility of the participant.
2.4 Assignment of contract:
In the event of transfer of the Registration File to a third party, the customer is required to inform the FAR WEST RANCH no later than 7 days before departure by any means allowing an acknowledgment of receipt to be obtained.
2.5 Interruption of service:
Any service interrupted by decision of the participant (for health, level, or other reasons) does not entitle FAR WEST RANCH to any reimbursement of unused services. Additional costs incurred by the participant as a result will not be reimbursed. Following medical repatriation by the participant's assistance, unused services cannot be reimbursed.
3/ MODIFICATIONS BY THE FAR WEST RANCH
3.1 Cancellation
• Lack of sufficient participants. When the minimum number of 2 or 5 participants following the tour is not reached, the service can be canceled no later than the day of departure. In this case, the customer is informed by e-mail or telephone. The customer then has the choice between the full refund of the sums paid or the transfer of the sums paid to another service of his choice. He cannot claim any compensation.
• Due to very unfavorable weather conditions. In this case, the customer is informed as soon as possible by e-mail or telephone. The customer then has the choice between reimbursement or deferral of the sums paid to another service of his choice. He cannot then claim any compensation.
• In the event of force majeure (unforeseeable and insurmountable incidents or events such as: wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.). The customer then has the choice between reimbursement or deferral of the sums paid to another service of his choice. He cannot then claim any compensation.
• The FAR WEST RANCH guide provided for the supervision of the service may cancel the service for any other reason that does not guarantee the service (injured horses, broken equipment, sick guide). The customer then has the choice between reimbursement or deferral of the sums paid to another service of his choice. He cannot then claim any compensation.
3.2 Changes before departure
Before departure, an itinerary, a program and a place of boarding can be modified for meteorological reasons. These details are stipulated in the registration files, on the website and on the online booking platform. The guide in charge of the service can redefine a route at any time, so that it is the most sheltered of conditions. The participant cannot therefore cancel without losing the full price of the service.
3.3 Modifications during the service
For security reasons or for organizational issues linked in particular to the weather conditions of the moment or at the level of the group, the program and itineraries may be subject to modifications. In these cases, only the guide is authorized to take the necessary decision(s) without notice. FAR WEST RANCH may then be required to pay for the additional services induced or to reimburse, except in cases of force majeure, the difference in price between the services provided and those provided.
3.4 Interruption of service:
Any service may also be interrupted by decision of the guide for duly justified reasons (security, weather). In this case, unless the interruption is due to a case of force majeure, FAR WEST RANCH reimburses the difference in price between the services provided and those provided.
3.5 Weight Limit
Regarding the authorized weight limit: we have a large number of horses but they are “small horses” for hiking and each can carry a different weight depending on their size. This is why we limit the weight of riders to 90 kg for our strongest horses. It is out of concern for the integrity of our horses that we ask you to be honest on this subject. If the Far West Ranch team realizes that there is an error regarding the weight, your reservation will be canceled and not refunded.
4/ RESPONSIBILITIES
4.1 Civil Liability
FAR WEST RANCH is insured for professional civil liability with an insurance company. However, the liability of FAR WEST RANCH does not replace the individual civil liability which each participant must hold.
4.2 Events outside the FAR WEST RANCH
FAR WEST RANCH cannot be held responsible for the partial or total non-execution of the planned service due to events external to it and in particular in the event of:
– incidents attributable to the participant (lateness, absence, risky attitude, etc.)
– incidents attributable to a third party,
– force majeure (unforeseeable and insurmountable incidents or events such as: wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.).
4.3 Rules of caution
The services taking place in the natural environment (on land), exemplary individual conduct and strict compliance with the safety rules formulated by the guide are required of each participant. FAR WEST RANCH would not be held responsible for the individual imprudence of one or more participants. FAR WEST RANCH reserves the right to exclude, at any time, one or more participant(s) whose behavior would endanger the safety of the group or its well-being, without any compensation being due to the offending participant.
4.4 Minors
FAR WEST RANCH agrees to accommodate minors provided that their age and physical aptitude make it possible to carry out the service under normal conditions. Except during services reserved for them, minors must be accompanied by at least one of their parents or any other adult person authorized by them.
4.5 Transport and accommodation before and after the service
In case of modification or cancellation of the service for the reasons mentioned above, FAR WEST RANCH is not responsible for the possible loss of the value of the transport tickets or the accommodation services that the customer would have contracted to go at the place of commencement of the service and/or to return home after the service. FAR WEST RANCH therefore strongly recommends that the customer opt for modifiable and/or refundable transport tickets and accommodation services.
5/EQUIPMENT
5.1 Clothing to Provide:
- Long pants
- Closed shoes
- Rain gear if necessary
The mandatory helmet will be provided by the structure.
6/PRICE
6.1 Price and payment:
The prices of FAR WEST RANCH services only include the transport of horses to the place of the hike, the guide, the rights of way, the insurance, the riding equipment etc. It is up to the customer to refer to the technical sheet of the service chosen to know the exact list of services included.
The prices of FAR WEST RANCH services have been calculated as accurately as possible according to the economic conditions known at the time of printing of its documentation. They are applicable from publication and until the day of publication of the following edition. They have no contractual value and are confirmed to the buyer upon registration. They are subject to possible modifications which apply to all persons already registered or wishing to register. Promotions and reductions are neither cumulative nor retroactive.
The establishment has chosen ultinow.com/stripe.com to secure online payments by credit card. The validity of the customer's payment card is verified by stripe.com. There may be a refusal of the payment card for several reasons: stolen card, blocked card, ceiling reached, entry error... In the event of a problem, the customer must contact his bank on the one hand, the establishment on the other hand to confirm their reservation and method of payment. In the case of a rate subject to online prepayment, the amount paid in advance, which is the deposit, is debited at the time of booking.
6.2 Small group (VIP) supplement:
If the customer wishes to privatize a service, he will then be charged an additional surcharge according to the terms below:
1 person alone: price multiplied by 6
group of two: price multiplied by 3
group of three: price multiplied by 2
group of four: price multiplied by 1.5
group of five: price multiplied by 1.2
7/RESPECT FOR PRIVACY
Privacy is a subject that is at the heart of the reservation platform's concerns. The customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the answers by the presence of an asterisk. The information processed is only intended for the establishment and the online payment service providers. This information is not passed on to other third parties. When paying online, the customer's bank details must be transmitted by the payment provider Stripe.com to the bank of the establishment, for the execution of the reservation contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection within the meaning of the Data Protection Act. However, the customer consents to this transfer necessary for the execution of his reservation. Ultinow SAS / Stripe.com in their professional capacity, have undertaken vis-à-vis the establishment to take all data security and confidentiality measures for said data transfers. Requests for information and registrations are processed electronically. 8/CONTESTATION
8.1 Complaint:
Any complaint relating to the service must be addressed by the customer to FAR WEST RANCH RIDET 1038207 whose head office is - lot 4 Métiéda, BOURAIL
8.2 Dispute:
Subject to the status of the plaintiff, any dispute is the exclusive responsibility of the Nouméa District Court.
